1. Acceptance of these terms
By placing an order through this ordering app, you confirm that you have read, understood, and agreed to these Terms & Conditions and our Privacy Policy. If you do not agree, please do not place an order.
2. About us
Ozmo Kebab & Mandi is the restaurant that prepares and serves your food. Hitex Consulting builds and operates the online ordering platform on the restaurant's behalf. Hitex Consulting is not the food provider and is not responsible for the food itself.
3. Eligibility
You must be at least 18 years old, or have the consent of a parent or guardian, to place an order. If you choose delivery, your delivery address must be within the restaurant's published delivery zone.
4. The ordering process
When you submit an order it is sent to the restaurant for review. A binding contract is formed only when the restaurant accepts your order (when the order moves out of its pending state). The restaurant may decline or cancel an order at its discretion — for example, if an item is unavailable, your address is outside the delivery zone, or the order is suspected to be fraudulent. If we cancel an accepted order, you will be refunded.
5. Pricing & payment
- All prices are shown in Australian Dollars (AUD) and are inclusive of GST where applicable.
- Payment is processed by Stripe at checkout. Your card is charged at the time you place the order.
- If the payment fails or is not completed, no order is placed and no charge is captured.
- Card details are entered directly into Stripe's hosted fields and are never stored by us. See the Privacy Policy.
6. Pickup, dine-in & delivery
Quoted preparation, pickup, and delivery times are estimates only and are not guaranteed. Delivery is dispatched through a third-party courier partner (Shipday). Once your order has been handed to you (or to a person at your delivery address), responsibility for the food passes to you.
7. Cancellations & refunds
- You may ask to cancel your order before the kitchen has started preparing it. Once preparation has begun, cancellation may not be possible.
- If an item is missing, incorrect, or not of acceptable quality, please contact the restaurant as soon as possible. Refunds and replacements are handled in line with the Australian Consumer Law.
- Nothing in these terms excludes, restricts, or modifies your rights under the Australian Consumer Law, including the statutory consumer guarantees that apply to goods and services.
8. Food safety & allergens
Allergen and ingredient information is provided in good faith based on the information available at the time. The kitchen handles a wide range of ingredients and cross-contamination is possible. If you have an allergy or dietary requirement, please contact the restaurant directly before placing your order so we can advise whether we can meet your needs safely.
9. Intellectual property
The menu content, photography, branding, design, and software that make up this ordering platform are owned by the restaurant and/or Hitex Consulting and are protected by intellectual property laws. You may not copy, reproduce, or reuse them without our written permission, except as needed to view and use the service for its intended purpose.
10. User conduct
You agree not to:
- Place fraudulent or knowingly false orders.
- Abuse, harass, or threaten restaurant staff or delivery drivers.
- Scrape, copy, or systematically extract data from the platform.
- Attempt to interfere with, disrupt, or gain unauthorised access to the service.
11. Limitation of liability
To the maximum extent permitted by law, Hitex Consulting's total liability to you for any matter arising from the operation of the ordering platform is limited to the value of the affected order. Nothing in these terms limits or excludes any liability that cannot lawfully be limited or excluded, including liability under the Australian Consumer Law.
12. Indemnity
You agree to indemnify the restaurant and Hitex Consulting against any loss, cost, or claim arising from your misuse of the ordering platform or your breach of these terms.
13. Governing law
These terms are governed by the laws of the State of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria for any dispute arising under or in connection with these terms.
14. Changes to these terms
We may update these Terms & Conditions from time to time. Updates will be posted on this page and the "Last updated" date will change. Your continued use of the service after an update means you accept the updated terms.
